Indecision 2024
Re: Indecision 2024
Trump has been charged with "wilful retention of national security material, obstruction and conspiracy"
clicky
Doesn't say when he'll be due in court.

Arrestmas? Already? Doesn't feel like a year since the last one.
Doesn't sound like there's a dissemination charge in there. Keeping only to the basic set of charges.

What happened with Biden's stuff on this? Is he in any legal jeopardy?

Probably not. Most of the indictment charges are about what Trump did and said in respect to the documents, not that they were at his house.El Pollo Diablo wrote: ↑Fri Jun 09, 2023 9:34 amWhat happened with Biden's stuff on this? Is he in any legal jeopardy?
Here grows much rhubarb.
Re: Indecision 2024
The espionage act charge is probably "wilfully retaining documents", and the rest are cover up charges.Chris Preston wrote: ↑Fri Jun 09, 2023 9:43 amProbably not. I'm not a lawyer. I've never prosecuted a case.
But the facts and admissions are all there. It's so easy peasy I reckon I could take this before a jury of 12 Florida red hats and get a conviction.

Well, with Milley – uh, let me see that, I’ll show you an example. He said that I wanted to attack Iran. Isn’t that amazing? I have a big pile of papers, this thing just came up. Look. This was him. They presented me this – this is off the record, but – they presented me this. This was him. This was the Defense Department and him. We looked at some. This was him. This wasn’t done by me, this was him.
All sorts of stuff – pages long, look. Wait a minute, let’s see here. I just found, isn’t that amazing? This totally wins my case, you know. Except it is like, highly confidential. Secret. This is secret information. Look, look at this. This was done by the military and given to me.
As president, I could have declassified, but now I can’t.

Not sure why there isn't a dissemination charge. Perhaps there will be. He's clearly guilty of that as well.
And it would take it up to serious prison time.

He's fired his lawyers. Again. Now looking for new lawyers who he hasn't previously cheated, lied to or not paid.
I can't think of what his defence will be. In the sense of the actual defence in court, rather than the rants about Her Emails and Hunter etc
Who can the defence call as a witness? Obviously they can't put Trump on the stand. But who else is there? What could they possibly say?
The only thing to try is to get the recording inadmissible and other legal technicalities.
Any real lawyer would be saying, here's the plea deal, you are going to plead guilty to X, they'll drop Y, and your prison time will be Z years.

Walt Nauta also indicted for his part in the conspiracy.

Ken White/Popehat has a pod cast on exactly that. Second half is behind a paywall, but in the first half he basically says if it was anyone else he be going to jail without any doubt. The only doubt is the political angle and the judge he lucked out on, which is in the paywalled half sadly.

Re: Indecision 2024
I thought this discussion on the All In With Chris Hayes podcast is worth a listen if only to hear all the respected journalists bursting into fits of uncontrollable laughter about how ridiculous it all is
https://all-in-with-chris-hayes.simplec ... ments-case
With regards to the boxes in the toilet- the access to the shower was blocked but the access to the toilet wasn’t. Was he reading the docs on the loo? What happened if he ran out of paper?

I’ve decided I should be on the pardon list if that’s still in the works

This pretty much guarantees he will be re-elected. Americans don't like to see the government pursuing a hapless defendent with numerous charges in multiple jurisdictions.

True, in American history no Presidential nominee facing numerous charges in multiple jurisdictions has ever lost.

Happy Arrestmas Day everyone!
Sounds like there'll be nothing much to see in this one. No cameras. Maybe not even footage of him arriving. But lots to enjoy anyway.
