Although not a reflection on the presidential vote, didn't a dead bloke recently get elected to a post somewhere in the US? (Well, in the last 12 months). Presumably due to similar grounds as you've laid out.

The SCOTUS hearings are not going well for our beloved President.

His lawyers can't invent enough to give the conservative judges cover - all precedent supports the congress position.

Most likely outcome is Trump will lose convincingly - but then ignore/delay/fight on some how. I'd guess Deutsche would promptly obey the courts, just to get rid of their burden.
I'll miss him after he's died in the pandemic
